Yesterday in the SCOTUS Trump v Slaughter oral arguments, Justice Kagan essentially put a nail in Humphrey’s Executor: ““Independent agencies also do a lot of rulemaking [Article l] and judging [Article 3].”
The Constitution SEPARATES these powers.
