What is campaign spending?
The question is NOT was a payment made related to the campaign, BUT would the payment not be made but for the campaign.
Federal Campaign Finance 11CFR 1(A)(113.1)Definitions (g) Personal use means any use of funds in a campaign account of a present or former candidate to fulfill a commitment, obligation or expense of any person that would exist irrespective of the candidate's campaign or duties as a Federal officeholder.
What does the Constitution say about Presidential immunity?
Nothing directly. But it does say that “the Party convicted shall nevertheless be liable and subject to Indictment.” This qualification of who would be subject to indictment implies that the President would have to be convicted in impeachment before being subject to indictment.
US Constitution Article I Section 3
Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.
