Bad News for Trump (haters)

There is bad news for all of the people who hate Trump and are hoping that his “Hush Money” conviction will hold. 

There are two new Supreme Court of the United States’ Opinions that will lead to overturning a conviction, if not actually requiring the Judge to vacate the jury’s verdict and acquit Trump. 

ERLINGER v. UNITED STATES - SCOTUS rules that criminal convictions require unanimity for all elements of the crime. Merchan’s jury instructions did not require unity for all elements of the crime. 

TRUMP v. UNITED STATES - SCOTUS rules that Presidential business discussion between the President and his officers cannot be used in criminal prosecution of Presidents for unofficial acts. Merchan allowed testimony by Cohen about official (administration of Federal Election Law) conversations between Trump and Attorney General.  

These are in addition to multiple critical and significant errors in the ”Hush Money” trial that would have certainly resulted in an overturning of a conviction in the appeal process: evidence allowed, evidence prohibited and jury instructions. 

And there were  multiple Constitutional Due Process issues in the ”Hush Money” charges that would likely have resulted in an overturning of a conviction in the appeal process: bill of particulars, selective prosecution, and fair and impartial process. 

By the way. Trump is not a convicted felon — at least, not yet. Judgment is not entered until the judge imposes sentence
