AZ not banning abortion
Arizona’s highest court MIGHT uphold a 1864 law. The court put its ruling on hold, and sent the matter back to a lower court to hear additional arguments about the law’s constitutionality.
The law, which was on the books long before Arizona achieved statehood in 1912, outlaws abortion from the moment of conception, except when necessary to save the life of the mother.
The majority opinion said that a “policy matter of this gravity must ultimately be resolved by our citizens through the legislature or the initiative process.
Similar to the brouhaha caused by the Alabama Supreme Court, this issue would likely be resolved quickly by the Arizona legislators to eliminate the old law and keep their current law, which has a 15 week limit for abortion for any reason
